Article 1 - Purpose

These terms govern the sales by 3d-mountain, located at 5 rue des Myosotis, 63610 Besse, of decoration items and other products, whether personalized or not.

Article 2 - Prices

Prices of our products are indicated in euros, including all applicable taxes (VAT and other taxes on the order date), unless otherwise stated and excluding handling and shipping fees.

For orders shipped outside mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties, or state taxes may apply. These fees and amounts are not the responsibility of SASU 3d-mountain. They will be your responsibility, and you are required to handle both declarations and payments to the relevant authorities in your country. We recommend checking with your local authorities for more information.

All orders, regardless of origin, are payable in euros.

SASU 3d-mountain reserves the right to modify its prices at any time, but products will be billed based on the prices in effect at the time the order is confirmed, subject to availability.

Products remain the property of 3d-mountain until full payment is received.

Please note: Once you take physical possession of the products ordered, the risk of loss or damage is transferred to you.

3d-mountain reserves the right not to record a payment or confirm an order for any reason, particularly in the case of supply issues or difficulties regarding the order received.

Article 4 - Order Confirmation

Any order placed on the website www.ma-signaletique-bois.com implies acceptance of these General Terms and Conditions. Confirmation of your order constitutes full and unconditional acceptance of these terms without exception or reservation.

All the data provided and the recorded confirmation will serve as proof of the transaction.

You declare that you are fully aware of these conditions.

Order confirmation will serve as your signature and acceptance of the operations carried out.

A summary of your order and the General Terms and Conditions will be sent to you in PDF format via the confirmation email of your order.

Article 5 - Payment

Validating your order implies the obligation to pay the indicated price.

Payment for your purchases is made by credit card through a secure system.

Article 6 - Withdrawal

In accordance with Article L.121-21 of the French Consumer Code, you have a 14-day withdrawal period from the receipt of your products to exercise your right of withdrawal without having to provide a reason or pay a penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions). Your responsibility is engaged. Any damage to the product may invalidate your right of withdrawal.

Return shipping costs are your responsibility.

If you exercise your right of withdrawal, 3d-mountain will refund the amounts paid within 14 days following notification of your request using the same payment method used for the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with Article L.121-21-8 of the French Consumer Code, the right of withdrawal does not apply to:

Services fully performed before the end of the withdrawal period and whose performance began after express prior consent of the consumer and renouncement of their right of withdrawal.
Goods or services whose price depends on fluctuations in the financial market beyond the control of the professional.
Goods made to the consumer's specifications or clearly personalized.
Goods that may deteriorate or expire quickly.
Goods that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons.
Goods that, after being delivered and by their nature, are inseparably mixed with other items.
Alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on market fluctuations.
Audio or video recordings or computer software that have been unsealed by the consumer after delivery.
Newspapers, periodicals, or magazines, except for subscription contracts to these publications.
Transactions concluded during a public auction.
Digital content not supplied on a tangible medium where performance began after express prior consent of the consumer and renouncement of their right of withdrawal.

Article 7 - Availability

Our products are offered as long as they are visible on the website www.ma-signaletique-bois.com and within the limits of available stock. For non-stocked products, our offers are valid subject to availability from our suppliers.
In case of unavailability after your order, you will be informed by email. Your order will be automatically canceled, and no payment will be processed.

Article 8 - Delivery

Products are delivered to the address indicated during the ordering process, within the timeframe specified on the order confirmation page.

In the event of delayed shipping, you will be informed via email of any potential impact on the delivery timeline.

In accordance with legal provisions, in the event of late delivery, you have the right to cancel the order under the conditions and procedures outlined in Article L 138-2 of the French Consumer Code. If the product is delivered after the cancellation, we will refund the product and shipping costs under the conditions of Article L 138-3 of the Consumer Code.

For deliveries by carrier, 3d-mountain cannot be held responsible for delivery delays solely due to the unavailability of the customer after multiple proposed appointments.

Article 9 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, as provided for in Articles 1641 and following of the French Civil Code. In case of non-conformity of a sold product, it can be returned, exchanged, or refunded.

All claims, requests for exchange, or refund must be made by email within 30 days of delivery.

Products must be returned in the condition in which they were received, with all elements (accessories, packaging, instructions). Shipping costs will be refunded based on the invoiced rate, and return shipping costs will be reimbursed upon presentation of receipts.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 - Liability

The products offered comply with French legislation. 3d-mountain cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities regarding the possibility of importing or using the products or services you intend to order.

In addition, 3d-mountain cannot be held responsible for damages resulting from the misuse of the product.

Finally, 3d-mountain cannot be held liable for any inconvenience or damage inherent in the use of the Internet, including service disruption, external intrusion, or the presence of computer viruses.

Article 11 - Applicable Law in Case of Disputes

The language of this contract is French. These terms are subject to French law. In the event of a dispute, the French courts will have exclusive jurisdiction.

Article 12 - Intellectual Property

All elements of the website www.ma-signaletique-bois.com are and remain the intellectual and exclusive property of 3d-mountain. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site, whether software, visual, or audio. Any simple or hypertext link is strictly prohibited without the express written consent of 3d-mountain.

Article 14 - Archiving Proof

3d-mountain will archive order forms and invoices on a reliable and durable medium that constitutes a true copy in accordance with Article 1348 of the French Civil Code.

The computerized records of 3d-mountain will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
